TERMS & CONDITIONS

 (These Terms & Conditions apply only to estate agents, developers and other approved property professionals using our Property Photography, Floor Plan or Video Services. Separate Terms & Conditions are available upon request for other types of clients or clients using other services).

1. Parties
   Steve Barron Photography (hereafter referred to as SBP) provide photography, floor plan and video services to approved businesses mainly in the estate agency, property and care home sectors (hereafter referred to as “the client”). SBP does not provide services to individuals or non-approved businesses (e.g. clients of estate agents) under these Terms and Conditions. Therefore, these terms and any business contracted between SBP and such approved business that instructs SBP to carry out its services are between SBP and that business or company and it is the responsibility of that business or company to settle the relevant fees charged directly. Unless otherwise agreed in writing, SBP does not consider the vendor or landlord of “the client” to be an approved business or entity and therefore the contract for any job is strictly between SBP and “the client” who is responsible for payment of fees.
2. Photography
   SBP will usually provide a download link the next working day after visiting the property for “the client” to download the final high-resolution images in jpeg format unless a different format is otherwise agreed. On rare occasions the download link may not be provided until two working days after visiting the property. SBP at their own discretion, unless instructed otherwise by “the client”, may have lights on or off for some, all or different rooms depending on what they deem best.
3. Floor Plans
   SBP will usually send the completed floor plan in jpeg format to the client within 24-48 hours (excluding weekends and bank holidays) following the visit to the location of the job. Floor plans are not exactly to scale and measurements are generally accurate to within approx. 3 inches (or 7.6 cm). Gardens are not measured but are sometimes estimated and in such instance this would be stated on the floor plan. The floor plan should not be relied upon for accuracy and should not be used for any other purpose than for buyers or tenants to see a general layout of the property. SBP accepts no responsibility for the accuracy or lack of accuracy for any floor plan and it is up to the recipient or anyone using the floor plan to satisfy themselves as to the accuracy. No appliances or other items are tested and nor are they deemed to be included in any sale or rental even if they may be depicted in the floor plan.
4. Video
   SBP offers two types of video service:
   1/ MP4 “Pan & Zoom” Motion HD Video. SBP will provide an mp4 video made with “pan & zoom” effects to give a feeling of movement to still images which are used in producing such video. These videos are intended to be short and punchy and therefore are usually between approx. 90 and 120 seconds in length, showing the main or most interesting rooms and aspect of the property at the discretion of SBP. Longer videos can be supplied but will incur an additional charge. The video is usually provided to “the client” via a download link within 48-96 hours (excluding weekends and bank holidays) following the visit to the location of the video/photo shoot.
   2/ MP4 “Walk-through” HD Video. This is a “walk-through” real-time video of the property and duration will depend on the size/number of rooms/spaces, etc. The video is usually provided to “the client” via a download link within 48-96 hours (excluding weekends and bank holidays) following the visit to the location of the video shoot. Videos will be edited to provide titles and optional company logo watermark (upon request). Videos will not contain any sound from the video shoot of the property but will have a light instrumental soundtrack added by default unless the client specifies that they would prefer no sound at all.
5. Property Dressing and Preparation
   SBP does not dress properties or move/re-arrange furniture or other items. It is the responsibility of the “the client” to ensure that the property is “photograph-ready” prior to SBP’s arrival at the location of any photo or video shoot. It is therefore, also the responsibility of “the client” to ensure that they, in turn, advise their client, if appropriate, to ensure that the property is “photograph-ready” prior to SBP’s arrival at the location of any photo or video shoot and that SBP does not dress properties or move/re-arrange furniture or other items. If the property is not photography-ready upon arrival and SBP are unduly delayed by more than 15 minutes in completing the job as a result of the vendor/landlord/tenant/agent having to move/arrange furniture items or tidy around after the arrival of SBP, at the discretion of SBP there may be an additional/surplus charge of 50% of the normal fee.
6. Payment Terms
   Payment is made in advance of each job at the booking stage using the online booking/payment on the SBP website. The booking only becomes valid once payment is made. Payment is made via secure methods and no financial information regarding the payment transaction is held by SBP.
7. Copyright
   The copyright of any material supplied by SBP including photo images, videos, floor plans is owned and retained by Steve Barron and/or SBP. Steve Barron or Steve Barron Photography may use any images/video and floor plans for marketing, sale or advertising purposes online or in print in connection with their own business. Any provided images, videos and floor plans are licensed to the named business or person on the invoice solely for them to use online, in print or in general marketing for their business. Any provided images, videos and floor plans are not to be passed, lent, shared, sold or given to any third party (except an advertising agency or company placing the product in media on “the client’s” behalf) without prior written consent from SBP and only then subject to any further charge or fee payable.  Use other than stated is strictly prohibited and is in breach of copyright which will be prosecuted to the full extent of the law.
8. Fees
   Prices and fees for jobs are as set out on the website and shown during booking and at the payment stage.
9. Congestion Charge
   If SBP need to enter, or pass through, the London Congestion Zone to reach the location for any job or to collect keys, then there is an £18.00 daily surcharge payable by “the client” to cover the Congestion Charge cost. The same applies to any congestion charge that may apply in other towns or cities and the fee payable to SBP in such scenario will be the same as the amount of the congestion fee charged for that city or town. This is payable in advance.
10. Cancellations & Refund Policy
    Confirmed bookings that are subsequently cancelled by “the client” either using the “cancellation link” (provided in booking confirmation emails) or via email or telephone with a minimum of 24 hours’ notice prior to the “start time” of the booking time or time slot will be entitled to a full refund less a 15% administration charge. Refunds are not provided for bookings that are cancelled with less than 24 hours’ notice prior to the “start time” of the booking time slot or where there is a “no show” on the day and any congestion charge fee (if applicable) on a “no show” or cancellation where SBP had already entered the congestion zone to get to the appointment or to collect keys will also be due if not previously paid in advance. Any such fee owing is payable within 5 days of the booked job date.
